Chief Guest :- Dr. S.Y.Quraishi (Former Chief Election Commissioner of India); Guest of Honour :- Mr. Gaurav Bhatia (Secretary, Supreme Court Bar Association), Prof. Manoj Kumar Sinha (Director, ILI, New Delhi) and Presided by Prof. Talat Ahmad (VC, Jamia Millia Islamia) with All Scholars/students/corporates/press etc.

Free and Fare Election System in India is a primary goal of this National Seminar. As we know that, Election is a segment of our society and life blood of Democratic Countries like India. But pathway is the Role of Election Commission (EC) For conducting a peaceful and crime free elections by appropriate technology, rules and regulations which is a integral part of our constitution. Model Code of conduct (MCC), is really remarkable in this light.

Dr. S.Y.Quraishi, Catch the statement of Hillary Clinton, “Indian Election is a Gold Standard”. Further, he says that, India’s election is a “WORLD’S LARGEST MANAGEMENT EVENT”. In short, God safe the Country without Election Commission. So, role of Supreme Court becomes very important in contemporary Indian politics in the light of Electoral reform in India. He also said that, first time in Indian History and politics; the present form of government (BJP) really want to do something special on Electoral reform in India which is Coined by PM, Modi.

More Importantly;

First, For Electoral Reform in India; we need to keep in mind that

“cycle of Political Finance and Public fundings by the Some Corporates and outsiders etc. which is going on in Indian Contemporary electoral Politics. In my Words, Which may be called in future writings “Industrialization and corporatisation of Indian Politics” by the Corporates etc. because max.no. of Corporates need licence, contracts and Government Supports. Industrialization by the media and faq news with the help of modern approach and tech.

Secondly, Decriminalized Policy. In this sabha, More than 183 MPs are under the crime record. More than 2 lakh 70 thousand cases are still pending. In 2013, BSP Chief mayawati said that, i’m not going to distributes any ticket to anyone qurashi also catch this one.

Thirdly, Is there any difference between Political party and Government? If we need Electoral reform than also make sure to do something about Political Reform. In Short, Political reform strengthen the Electoral Reform in India.

While, Mr. Gaurav Bhatia (Secretary, Supreme Court Bar Association) believe that political party do not wants to do something on People participation Act. You may see landmark judgement of SC 2003 in the same context. We know that, parliament is called “temple of democracy” we need to stop criminals entry in elections. In reality, 10 time Attempted murderer person can elect easily in election. So, We need to stop this one also. we need to change the destiny of our country by modern resources. Now, we are not talking about women empowerment, poverty, hunger etc. but talks about, (JUB TAK RHEGA SMOSHA MAIN AALU TAB TAK RHEGA BIHAR MAIN LALU).

Three Safeguards as a Way out

  1. Make a efficient appointment of election commissioner. Which needs institutional safeguard.
  2. Equality of CVC, CIC etc.
  3. Decision making of EC becomes very important. etc.

During the elections, all civil servants came under the EC Deputation. So, Transfer on deputation are becomes important. It depends on our punishment policy, transfer policy and such other policies. If any government servant come under suspense which is danger for Free and fare election than EC Role becomes very important with regard to Transfer and punish those who involves in such above concern. Result is that; in that situation EC have capability & ability to transfer any officers during the election period. e.g., chief secretary, Home secretary, DGP, DM, SP etc. In short, Neutrality is totally No-negotiate.

Significantly, Election commission have no limits of its power. Which is essential for provide playing field for parties that requires “Free and Fare election”. Criminal people have no such place for election. Remmember, Biggest power of Indian Democracy “WE THE PEOPLE OF INDIA” so, we can change it.

Fundamental Questions, Legislation to regulate political party? how the real motive can be achieved. Also interpretation, implementation and law made by legislation and identification of voters are also becomes very important electoral reform in India. And also try to build more effective political consensus with all political parties. Impact of communal politics are harmful for our democratic country. Now, Through the Mobile you can trace EVM by the secrete code. It need to implement RTI and think about Right to reject etc. are way out to resolve many problems regard to election funding in India.

When India foundation organised a one – day symposium on One nation, One Election on November 26, 2016. SY Quraishi, Former Chief Election Commissioner, it is a very beautiful concept. On March 19, 2016 Indian Prime Minister, Modi flag the above idea he talk about the same in his speech. Quraishi, In 2010, Lal krishna Advani, ADR (Association for democratic reform : 2015), parliamentary Committee (2015) advocate simultaneous election. Election Commission of India (2015), suggested that it is a very good idea we need to discuss/debate about the same.

Importantly, Quraishi said that, within 33 days EC have an ability to conduct election. In reality, most of the election conduct in various phases (6 or 7) which consume huge time (26 day+21 day for schedule model code etc. So, it need to do decrease the time e.g. provide the power to change 21 day for schedule model to 7 days and 6 or 7 phases to 1 or 2 phases than it is possible to conducts election within 33 days (Election finish in 33 days).

However, The Model code of conduct (MCC) which comes into force with the announcement of poll dates, prevents government from announcement any new schemes, make any new appointment, transfers and posting without the approval of EC, it affect policy making and governance as the government is trapped in short term thinking it also destabilises duly-elected governments and impose a heavy burden on the exchequer, It also Increase the cost of management to the EC etc. these are problems associated with frequent election.

Nowopinion pole misguided by MEDIA which really impact on common men mind setup. But you can also see that Results comes in opposite direction. So, Nowaday Some Media and Number of News Channels Funded by parties thats why they made opinion pole with the direction of fund donors party. Finally, EC have no limits of its power. Which is essential for provide playing field and suitable, peaceful environment for Election that requires Free and Fare election. We need to build think tank network on this. Criminal people have no such place for election. Biggest power of Indian Democracy “WE THE PEOPLE OF INDIA” so, we can change it. Let us see that our democracy is ready to electoral reform or not..
